Subject: Application for Immigrant Visas

1.0 POLICY/PURPOSE:

1.1 All applicants for the University of Wisconsin-River Falls positions must be eligible to work in the United States.

1.2 All new hires must submit documentation establishing both identity and work authorization.

1.3 Under certain limited conditions, the University of Wisconsin-River Falls, working through its Human Resource Department, will submit paperwork to petition for work authorization on behalf of individuals.

1.4 This will be done for new tenure-track faculty and permanent non-instructional staff.

2.0 OVERVIEW/BACKGROUND:

2.1 The process of petitioning for work authorization is lengthy as well as costly, involving up to three government agencies.

2.2 The final decision to grant a visa is made by the Immigration and Naturalization Service (INS). Because the outcome is not guaranteed, those involved in the hiring process need to make it clear that the University's role is only to submit application for a visa.

2.3 The Department of Human Resources has sole authority for filing H1-B1 temporary worker and permanent residence petitions on behalf of UW-River Falls.

2 .4 The role of Human Resources is limited to those aspects of document preparation and submission that are directly related to the University's interests and responsibilities as an employer.

2.5 Due to cost, time and length of the application process, UW-River Falls will not seek work authorization for classified employees, employees in training, lecturing positions or visiting professors.

 

3.0 UNIVERSITY RESPONSIBILITIES:

4.0 DEPARTMENT/UNIT RESPONSIBILITIES:

College Dean
Qualified Faculty/Staff Member

5.0 PROCEDURE:

5.1 The employing college/department initiates the process with Human Resources.

5.2 The employing college/department and the interested faculty or staff member work with Human Resources to complete the Intake Form.

5.3 Once the Intake Form is completed, Human Resources begins the process of submitting paperwork for attaining the H1-B1.
